Terms of Service
These Terms of Use apply to your access and use of the website (“Website”) and mobile applications (“App”) and any other free or paid online products and services (collectively, our “Services”) provided by ColorBlossom (“ColorBlossom” or “we”).
By accessing or using any of our Services, you agree to be bound by these terms and conditions and ColorBlossom’s Privacy Policy, incorporated herein by reference (together, the “Agreement”). Your use of the Services is expressly conditioned upon your consent to all of the terms and conditions of this Agreement, including the arbitration clause and class action waiver to resolve any disputes with ColorBlossom. If you do not agree to any of these terms and conditions, please do not use our Services.
1. General Conditions and Acceptance
Please read this Agreement carefully before using the Services. If you do not agree to these terms, you must not use the Services. By accepting this Agreement:
You acknowledge that you have read and understood its content, including our Privacy Policy.
You confirm that you are at least 18 years old and have the legal capacity to contract.
You agree to all the obligations set out in this Agreement.
This Agreement is valid indefinitely and applies to all use of our Services, subject to the termination clauses below. This is a legally binding contract between you and ColorBlossom.
2. Object of the Agreement
ColorBlossom is an AI-powered seasonal color analysis and personal styling platform. We provide personalized recommendations based on your selfie, appearance, and preferences. These include your seasonal color palette, outfit ideas, makeup shades, nail colors, and hairstyle suggestions. Some services are available on a paid basis.
ColorBlossom may also receive compensation from affiliate partners (such as retailers or brands) when users visit or purchase through links displayed in the app. Prices and availability of items displayed in the app are determined by the retailer, not by us.
The Services are intended solely for your personal, non-commercial use and may only be used in accordance with this Agreement. To use the Services, you will need to provide a clear photo (selfie) and optional clothing images and preferences.
3. Registration and Eligibility
To use certain features of the app, you may need to create an account. When doing so:
You must provide accurate, up-to-date information.
You must be at least 18 years old.
You may not use another person’s account.
You are responsible for keeping your password secure.
If we believe your account belongs to a minor or contains false information, we may suspend or delete it. Each person may only maintain one account.
4. User Content
Our Services may allow you to create and share outfits, images, text, and other materials (“User Content”).
You retain ownership of your content but grant ColorBlossom a non-exclusive, royalty-free, worldwide license to use, display, and adapt your content in connection with the Services (subject to the Privacy Policy).
You must ensure that any content you upload:
Is legal and non-infringing.
Does not contain personal data of others without their consent.
Is free of harmful code, spam, or offensive material.
We may remove any User Content that violates this Agreement or applicable laws.
5. Your Use of the Services
You agree to use the Services lawfully and in accordance with these terms. You may not:
Resell, rent, or redistribute the Services.
Reverse-engineer or copy the app’s code.
Circumvent security measures.
Upload viruses or harmful software.
Use the service for illegal, misleading, or harassing purposes.
Attempt to collect data from other users unlawfully.
Violation of these rules may result in immediate account termination.
6. Export Controls
You agree to comply with all applicable export control laws and regulations. You must not use or access the Services if you are located in a country subject to government embargo or are on any denied party list.
7. Paid Services and Subscriptions
Some parts of the Services are paid. If you subscribe to a paid plan:
Subscriptions renew automatically unless canceled.
Prices are displayed before purchase and may change.
Payments are processed through app stores (Apple App Store / Google Play).
Cancellations and refunds follow the app store’s terms.
Promotional pricing may apply to new users for a limited time.
If prices change, you will be notified in advance and can cancel before renewal.
8. Privacy
We process your personal data in accordance with applicable privacy laws. Please refer to our Privacy Policy for details.
9. Limited License
You are granted a limited, non-exclusive, non-transferable, revocable license to use ColorBlossom for personal, non-commercial purposes. All intellectual property in the app, website, and its content belongs to ColorBlossom or its licensors.
You may not copy, modify, distribute, or exploit the content without our written consent.
10. Links to Third Parties
The Services may contain links to third-party websites, including retailers. We are not responsible for their content, pricing, or policies. Your interactions with third-party websites are governed by their terms and privacy policies.
11. Indemnification
You agree to indemnify and hold harmless ColorBlossom, its officers, employees, and partners from any claims, damages, or expenses arising out of your use of the Services, your content, or your violation of this Agreement.
12. Warranty Disclaimer and Limitation of Liability
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied.
ColorBlossom does not guarantee:
That the Services will be error-free or uninterrupted.
That content is accurate or suitable for every user.
That recommendations will meet your expectations.
In no event shall ColorBlossom be liable for indirect, incidental, or consequential damages. Our maximum total liability will not exceed the amount you have paid to us, or $100 if no payment was made.
13. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of Spain. If you live in the EU or UK, disputes will be resolved in the courts of Barcelona, Spain.
If you live elsewhere, disputes will be resolved through binding arbitration under the American Arbitration Association’s rules. You agree to resolve disputes individually and waive participation in any class action.
14. Electronic Communications
By using the Services, you consent to receive electronic communications from ColorBlossom, including service updates, offers, and account-related notices.
15. Termination
We may suspend or terminate your account at any time if:
You violate this Agreement.
You are inactive for 6 months or more.
We discontinue the Services.
Upon termination, your access will be revoked and your data may be deleted.
16. Severability
If any provision of this Agreement is deemed unenforceable, the remainder will continue in full force and effect.
17. Notice and Takedown
If you believe content on our Services infringes your copyright, you can contact us at info@colorblossom.co and provide:
A description of the infringing content
Its location
Your contact details
A good faith statement and signature
18. Modifications
We may update this Agreement at any time. If changes are material, we will notify users where required by law. Continued use of the Services after changes take effect means you accept the updated terms.
